West Bountiful considers smoke shop ban

WEST BOUNTIFUL - A public hearing has been set for Tuesday, Jan. 28 at 7:30 p.m. by the West Bountiful City Council to receive input on whether a smoke shop should be allowed in the community.

The planning commission has adopted a moratorium on allowing any smoke shops, including those that would sell e-cigarettes. That is to allow time to study the issue, City Administrator Duane Huffman said.

"We didn't have any of those types of businesses and weren't sure if it would be a good fit or not," he said.

The planning commission has discussed the issue in two of its meetings, in addition to reviewing state laws on smoke shops, Huffman said.

“I believe we are essentially looking at prohibiting them in West Bountiful,” he said. “Our understanding is that we can do that.

“Because of state law, there is a very limited area where they would be allowed anyway,” Huffman said.

“In that very limited area, is that a good fit? Is it good for the community?” are questions that must be addressed, he said.

Centerville limited smoke shops to one that already was in place prior to new state laws, allowing it to stand using a grandfathering clause.

In late December, four Bountiful vapor shops were notified they would have to close by year’s end. City officials said it was because they violated state law on where they could be located in relation to schools, churches, parks and other public areas.

That decision was later rescinded, giving them another year to operate.

The meeting will be held at city hall, 550 N. 800 West.
